Safe Harbor Protection

Scarlet operates as a platform for user-generated content and is protected under the safe harbor provisions of the Digital Millennium Copyright Act (DMCA). We do not host, create, or endorse copyrighted material. All content is uploaded by users at their own discretion.

1. Our Role as a Platform

Scarlet is a platform that allows users to share information, reviews, and content. As a platform provider:

  • We do NOT create, upload, or endorse user-generated content
  • We do NOT verify the ownership or copyright status of user uploads
  • We act in good faith to remove infringing content upon proper notification
  • We provide tools for copyright holders to report infringement

2. User Responsibility

Users who upload content to Scarlet are solely responsible for ensuring they have the right to share that content. By uploading content, users represent and warrant that:

  • They own the content or have permission to share it
  • The content does not infringe on any third-party rights
  • They accept full liability for any copyright claims

User Content Disclaimer

All screenshots, images, and media uploaded by users are their own responsibility. Users agree to indemnify Scarlet against any copyright claims arising from their uploads.

3. DMCA Takedown Procedure

If you are a copyright owner or authorized agent and believe that content on Scarlet infringes your copyrights, you may submit a DMCA takedown notice. Your notice must include:

Required Information for DMCA Notice:

  • Your physical or electronic signature
  • Identification of the copyrighted work claimed to be infringed
  • URL(s) or description of where the infringing material is located
  • Your contact information (name, address, phone, email)
  • A statement that you have a good faith belief the use is not authorized
  • A statement under penalty of perjury that the information is accurate

4. Counter-Notification

If you believe your content was wrongly removed, you may file a counter-notification. Your counter-notice must include:

  • Your physical or electronic signature
  • Identification of the removed material and its location
  • Statement under penalty of perjury that removal was a mistake
  • Your name, address, phone number
  • Consent to jurisdiction of your local federal court

5. Repeat Infringers

In accordance with the DMCA, we will terminate accounts of users who are repeat infringers. We define a repeat infringer as a user who has received three or more valid DMCA notices.

7. Good Faith

We operate in good faith and promptly respond to valid DMCA notices. We will:

  • Remove or disable access to infringing content expeditiously
  • Notify the user who posted the content
  • Provide the user an opportunity to file a counter-notice
  • Restore content if required by a valid counter-notice

8. Designated Agent

DMCA notices should be submitted through our support system. All notices will be reviewed and processed by our designated DMCA agent.

Warning: False Claims

Making false DMCA claims is punishable under 17 U.S.C. ยง 512(f). Submitting a materially false DMCA notice may result in liability for damages, including costs and attorneys' fees.

9. Third-Party Content

Scarlet may display or reference third-party trademarks, logos, or content for informational purposes. Such references are:

  • Not an endorsement by the trademark owner
  • Used under fair use for commentary and criticism
  • The property of their respective owners
